purchases and the use of products and services offered by Earthum. They apply to digital and
physical products, as well as to other offers made available via the Earthum website.
The purpose of these terms and conditions is to set out the key legal and organisational principles for
both parties in a clear and transparent manner. These include, in particular, provisions
relating to the conclusion of the contract, payment, delivery, rights of use, returns and liability.

2. SCOPE
These Terms and Conditions apply to contracts
Consumers (B2C) and
Businesses (B2B)
relating to the purchase of digital and physical products
and other services offered by Earthum.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly
not attributable to either their commercial or their self-employed professional activities.
A trader is a natural person, a legal person or a partnership with legal capacity who, when
entering into a legal transaction, is acting in the course of their commercial or self-employed professional activities.

4. CONCLUSION OF THE CONTRACT
The presentation of products on the website does not constitute a legally binding offer,
but rather a non-binding invitation to place an order. Upon completion of the
ordering process, the customer submits a binding offer to conclude
a contract of sale. The contract is concluded as soon as Earthum
expressly confirms the order, provides the service
or arranges for dispatch.
Earthum reserves the right to refuse orders in individual cases, in particular in the event of
obvious errors, misuse, unavailability or legal obstacles.
5. CUSTOMER ACCOUNT
A customer account is required to purchase digital products so that
downloads, access, products and future updates can be managed.
For physical products, guest orders may also be possible
, where available. However, it is still a good idea and recommended to create a customer account.
The customer is obliged to treat their login details as confidential
and not to make their customer account accessible to third parties.
6. PRICES & PAYMENT
The prices stated on the website at the time of ordering apply.
Unless otherwise stated, prices are quoted in the currency shown
in the shop. Taxes, delivery charges and any other additional costs
will be shown separately during the ordering process, where applicable.
Depending on technical integration and availability,
the following payment methods in particular may be offered:

7. DIGITAL PRODUCTS
Once a purchase has been successfully completed, digital products are usually made available for immediate download
and can be accessed via the customer’s account. Unless otherwise specified on the product page
or during the ordering process, the following applies to digital products:

⇒ Download access for at least 18 months from the date of purchase
⇒ Free provision of product updates for 18 months
from the date of purchase, provided that updated versions are released
⇒ It is the customer’s own responsibility to back up the files in good time.
RIGHTS OF USE FOR DIGITAL CONTENT
Upon purchasing digital products, the customer is granted a simple, non-
transferable licence for private use, unless otherwise specified in the relevant
offer. In particular, the following are not permitted:
⇒ Making material available to the public
⇒ Resale and disclosure to third parties
⇒ Reproduction beyond private use
⇒ Commercial use without the express written consent of Earthum
⇒ Modification, circumvention of technical protection measures or redistribution
in modified or unmodified form, unless expressly permitted by law
All copyright, trade mark and other intellectual property rights remain with Earthum or the respective rights holders.
8. PHYSICAL PRODUCTS
Unless otherwise stated, physical products are usually prepared for dispatch within
3 days or handed over to production or dispatch partners.
Delivery usually takes place within 10 days, depending on the type of product, partner,
destination region and delivery provider. Delivery times may vary in individual cases.
Earthum generally delivers internationally.
The focus and main emphasis are on:

Actual availability for delivery to specific countries or regions depends on the
partners and delivery service providers involved, as well as product-specific conditions.
If a physical product is unavailable or there is a significant delay in delivery,
the customer will be informed. Any amounts already paid will be refunded where necessary.
9. CANCELLATION & RETURNS
Digital products. To the extent permitted by law, digital products are excluded from cancellation and return once
access has been provided or the download has taken place.
Physical Products. Where applicable by law and unless specific
exceptions apply, a 14-day cancellation or return period applies.
Customised Products. The following, in particular, are excluded from the right of withdrawal and from
returns:

⇒ Individually Made Products
Goodwill arrangements. Irrespective of statutory rights, Earthum may, in individual cases,
offer voluntary goodwill solutions. There is no entitlement to such goodwill. In special
exceptional cases, the circumstances may be assessed on a case-by-case basis.
10. WARRANTY & STATUTORY RIGHTS
The statutory warranty rights apply, insofar as they are applicable and have not been validly restricted
. For business customers, the warranty may, to the extent permitted by law, be restricted to the extent permitted by law
. Where mandatory
consumer rights or statutory guarantees apply in certain countries or regions, these remain unaffected.
11. PRODUCT DETAILS
Earthum reserves the right to amend content, products, descriptions, designs, prices and
technical delivery formats at any time, provided that this is reasonable for the customer
and does not affect any contracts that have already been concluded.
Digital products that have already been purchased will remain available for the download and access period specified in each case at

12. LIABILITY
Earthum shall be liable without limitation for damages arising from wilful misconduct or
gross negligence, as well as in the event of injury to life, limb or
health. In the event of a breach of material contractual obligations due to slight negligence
, liability shall be limited to foreseeable damage typical for this type of contract.
Furthermore, liability is excluded to the extent permitted by law.
The above limitations of liability shall not apply
where mandatory statutory provisions preclude them.
13. INTERNATIONAL APPLICABILITY
This website is aimed at international customers. Earthum generally sells
worldwide, provided that delivery, availability and the legal framework permit this.
For customers in certain countries or regions, mandatory national
or regional consumer protection regulations may apply in addition to these Terms and Conditions. Such mandatory rights remain unaffected.
14. APPLICABLE LAW
The law of the USA, Florida, shall apply, to the exclusion of the UN Convention on Contracts for the International Sale of Goods,
, provided that this is not precluded by mandatory consumer protection legislation.
If the customer is a consumer and resides in a country where mandatory consumer protection provisions
apply, which may not be waived by a choice of law, these protective provisions shall remain unaffected.
15. DISPUTE RESOLUTION
Earthum is neither obliged nor willing to participate in dispute resolution proceedings
before a consumer arbitration board, provided there is no mandatory
legal obligation to do so. The EU ODR platform was discontinued on 20 July 2025.
16. FINAL PROVISIONS
Should any individual provisions of these General Terms and Conditions be or
become invalid, in whole or in part, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced, insofar as legally possible, by a valid provision
that most closely approximates the economic purpose of the invalid provision.
17. CLOSING REMARKS
With these General Terms and Conditions, Earthum establishes a clear framework for
orders, purchases and the use of the products and services on offer. They serve to set out
key procedures, rights and general conditions in a transparent and clear manner.
Even if individual offers, regions or product types entail specific requirements
, the aim is always to ensure a fair, clear and reliable arrangement for both parties.
