RIGHT OF WITHDRAWAL
Returns & Refunds
Where provided for by law, consumers have the right to withdraw from contracts for physical products
within 14 days without giving any reason.
For digital products, the specific provisions and exclusions set out below apply.
The withdrawal period is 14 days from the day on which the consumer or a third party designated by them,
who is not the carrier, took possession of the goods. In the case of partial deliveries or multiple items
in a single order, the period begins upon receipt of the last item or partial delivery.
To comply with the withdrawal period, it is sufficient to send the notification of your intention to exercise your right of withdrawal via

For digital content, the right of withdrawal may, under certain conditions

CONSEQUENCES OF WITHDRAWAL
If a contract is validly cancelled, all payments received by Earthum from the consumer
, including standard delivery costs, will be refunded without delay and at the latest within 14 days of
receipt of the notice of cancellation. The refund will be made using the same payment method
as that used for the original transaction, unless expressly agreed otherwise
. This will not result in any additional costs for the consumer.
Earthum may withhold the refund until the goods have been received or until
proof has been provided that the goods have been returned, whichever is
the earlier. The consumer must return the goods to Earthum or hand them over to Earthum without delay and at the latest within
14 days of the date on which the withdrawal was notified
. The deadline is deemed to have been met if the goods are posted before the end of the 14-day period.
⇒ The consumer is responsible for the direct costs of returning the goods. Earthum is not required to cover these costs.
The consumer is only liable for any loss in value of the goods if this loss in value is attributable to handling that is not necessary for
checking the nature, characteristics and functioning of the goods.
EXCLUSION OF THE RIGHT OF WITHDRAWAL
The right of withdrawal does not apply or may lapse prematurely if statutory grounds for exclusion
apply. This applies in particular to products, goods or services which, in accordance with statutory provisions
, are excluded from the right of withdrawal. To the extent permitted by law, the right of withdrawal does not apply, in particular, to:
⇒ Bespoke items or personalised products
⇒ Custom-made or customised products
⇒ A withdrawal that was not exercised within the time limit or in an unambiguous manner
In exceptional circumstances, the facts of each case may be examined on a case-by-case basis.
NOTE ON DIGITAL PRODUCTS

Should a digital product fail to function, be faulty or not be provided as intended,
the matter in question will first be investigated. Where a defect is found, Earthum may, at its discretion, provide a
correction, re-delivery, a replacement product or an equivalent new product.
Only if such a remedy is not possible, unsuccessful or unreasonable may, on a case-by-case basis, a
refund or termination of the contract...
Irrespective of this, statutory rights in respect of defects or warranty claims may apply,
if a digital product is faulty or has not been supplied in accordance with the contract.
